Online store eKardinadThe owner of .ee (hereafter Online Store) is Bestline OÜ (registry code 12406724), with address Külma 42 Tallinn 10618.

 

Validity of the sales contract, goods and price information

The terms of sale apply to the purchase of goods from the Online Store.

The prices of the products sold in the online store are indicated next to the products. The price includes a fee for delivering the goods. All prices of goods sold in the online store are in euros. The color samples of the products in the online store may differ from the reality (depending on the resolution of the computer or smart device and the capabilities of the video card).

The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when ordering.

Information about the goods is provided in the Online Store directly next to the goods.

 

Placing an order

To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and choose the appropriate method of product delivery. Then, the amount of the fee is displayed on the screen, which can be paid by advance invoice or through the following payment methods

  • Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele
  • Pay later solutions: LHV installment payment

Payments are handled by Montonio Finance. Payment takes place outside the Online Store in a secure environment - when paying with a bank link, in the secure environment of the respective bank. The seller does not have access to the customer's bank and credit card data. The contract enters into force from the receipt of the amount to be paid to the online store's current account.

If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. Delivery costs) will be refunded immediately, but not later than within 14 days of sending the notice.

 

Delivery

Goods are sent to the following countries: Estonia, Finland

To pick up the goods, the buyer has the following options: the option of picking up the goods himself, Omniva service, DPD, Smartpost and Itella services.

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally arrive at the destination specified by the buyer within 10-14 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 14-20 calendar days.

In exceptional cases, the right to deliver the goods within up to 45 calendar days.

 

Duty to receive and inspect goods

When receiving the Goods, the Buyer is obliged to check the conformity of the quantity of the Goods with the Order.

Upon receipt of the goods, the Buyer is obliged to inform the Online Store immediately of any deviations that are visible to the eye during the delivery of the Goods.

The risk of accidental destruction and damage to the goods passes from the Online Store to the Buyer upon delivery of the Goods.

 

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days for products that are not specially made for the buyer (e.g. blinds with suitable dimensions ordered by the buyer from the e-shop).

Goods specially made for the buyer with a special design and/or dimensions cannot be exchanged (e.g. curtains that can be bought in the e-store eKardinad.ee according to the buyer's measurements).

The right of withdrawal does not apply if the buyer is a legal person.

In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, you must submit a statement of withdrawal from the purchase of the goods, which should be sent to the e-mail address info@ekardinad.ee at the latest within 14 days of receiving the goods.

The costs of returning the goods shall be borne by the buyer, unless the reason for the return is due to the fact that the product to be returned does not correspond to what was ordered (eg a defective or defective product).

The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.

Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or the buyer has provided proof that he has returned the item, whichever is earlier.

If the buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for a cost that exceeds the cost related to the usual delivery method.

The online store has the right to withdraw from the sale transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.

 

Hoiutasu

The online store has the right to charge the Buyer a fee for storing the goods in the online store's warehouse (Külma 42 Tallinn 10618) for a time that exceeds the agreed delivery time by more than two weeks. The storage fee is 3% of the price of the stored goods for each day of storage.

 

Ownership of goods

Ownership of the Goods is transferred from the Online Store to the Buyer upon full payment of the purchase price of the Goods.

 

Right to lodge a claim

The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. Refuting the corresponding assumption is the responsibility of the Webshop.

Material samples and descriptions of the Goods are used to approximate the quality of the Goods. In the case of Goods with individual characteristics (e.g. designer curtains), a claim can only be made regarding the technical implementation, as the named product does not have specific characteristics. Natural material In the case of goods, the natural variability of the material is taken into account.

The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Webshop will return all fees associated with the sales contract to the buyer. The online store responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.

 

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver goods. Bestline OÜ has a personal data controller, the Bestline OÜ company transfers the personal data necessary for making payments to the authorized processor Montonio Finance.

The online store will send the buyer newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.

The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.'

 

The online store is not responsible

For damage to the Goods caused by the buyer's fault or negligence;

  • for defects that have arisen as a result of improper installation and/or non-intended use of the product by the Buyer;
  • for the natural physical wear and tear of the goods under normal use
  • in case of usage conditions different from the norm (humidity, temperature, wind, etc.)

Force Majeure

The Online Store is not responsible for non-fulfillment of the Order if it is due to circumstances beyond the Online Store's control.

All disagreements between the Online Store and the Buyer will be resolved through negotiations in Estonian. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer's complaint in the commission is free of charge.
